Prospective Marriage/Fiancé 300 Visas


The Prospective Marriage Visa (Subclass 300 Visa) is available to applicants who are currently outside Australia and engaged to be married to their Australian Partners. To clarify, this visa is often also referred to as a Fiance Visa and is available to applicants who:

-       Are at least 18 years of age

-       Have met their Australian Partners in person and know each other personally

-       Genuinely intend to marry their Australian Partners

-       Satisfy the Health Criteria

-       Satisfy the Character Requirements

The 300 Visa is suitable for people in relationships who are not yet ready to get married, or cannot meet the evidence requirements of proving they are a de facto couple. The purpose of the 300 Visa is to provide a vehicle for applicants to enter Australia, solemnize their marriage, and then apply for the on-shore Subclass 820/801 described here. Importantly, this visa will be valid for 9 months from the date it is granted, giving applicants sufficient time to enter Australia and take the next step in their relationship.

Other important factors to consider are that in support of the applicant’s claims to genuinely intend to marry, all applicants should provide evidence that arrangements have been made for the marriage ceremony to take place after the applicant's first entry to Australia. In most cases, this will require that a Notice of Intention to Marry (NOIM) has been submitted with an Australian marriage celebrant. The NOIM must be lodged no less than 1 month and no more than 18 months before the proposed date of the ceremony.

Furthermore, both partners must be free to be married, meaning that if either the applicant or the sponsor have previously been married, that they can evidence a formal divorce has been obtained ending the previous relationship.
