Aged Parent Visas (Inside Australia)


If you are the Parent of an Australian permanent resident or Citizen currently inside Australia, then there may be several visa options available for you to stay permanently in the country.

Generally speaking, Parent visas require that you satisfy the following requirements:

1.     That you be physically located inside Australia at the time of applying for the Visa

2.     That you have an Australian Citizen or permanent resident child (or their partner) that can sponsor you

3.     That you and your partner meet the balance of family test

4.     That your family provides an Assurance of Support and Financial Bond to the Government

5.     That you are 65 years of age or older if applying from inside Australia

6.     Satisfy the Health Criteria

7.     Satisfy the Character Requirements

The Aged Parent Visa (Subclass 804 Visa) allows applicants over the age of 65 years of age and older to apply for a Parent Visa in Australia to stay with their Australian children. Importantly, the current processing times for the 804 Visa are approximately 30 years, however applicants can remain in Australia while the 804 visa is processing. Depending on the country of passport, some applicants may be entitled to Medicare whilst in Australia, however under most circumstances the Australian pension will not be available.

The Contributory Aged Parent Visa (Subclass 884 & Subclass 864) visas are also available to Parents who are 65 years of age and older and inside Australia to stay in the country with their Australian children. Importantly, the processing times for these visas are significantly shorter than the Aged Parent Visa discussed above, however they incur substantial 2nd Visa Application Charges payable to the Department of Immigration and Citizenship. The option of two visas allows applicants to pay the 2nd Visa Application Charges in two installments if preferred, by first applying for the temporary Subclass 884 and eventually transitioning into the permanent Subclass 864.

Balance of Family Test

Whether you apply under the Subclass 804 Visa or Subclass 884 & Subclass 864 Visa, you and your partner will need to meet the Balance of Family Test. To satisfy this requirement at least half your children must live permanently in Australia or more of your children live permanently in Australia than in any other country.

Sponsor

Your sponsor will need to be your child or their partner and an Australian citizen, Australian permanent resident or eligible New Zealand citizen. Importantly, the sponsor needs to have been living lawfully in Australia for at least two years before you apply for this visa.
